Terms Of Service (TOS)
Please read the Terms of Service ("TOS," "Terms and conditions," or "Uses Agreement" or "T &
C") below, which applies to all our features products and services provided by CloudSensy ("cloudsensy.com,"
"us,", "our"). This TOS is updated regularly and you should read it carefully before purchasing any Services
from us. Purchasing any Service from CloudSensy implies that you agree to be bound by it. It is very
important that you read the TOS before you purchase any Service(s) from cloudsensy.com .
Agreement with
Customer
It is your responsibility to ensure that you understand our Terms of Service before signing
up for any of the services on CloudSensy. The TOS apply to all Services you receive from CloudSensy during
the Term or Renewal Term. During the course of using our services, you will only use licensed and legal
third-party software. At any time, CloudSensy reserves the right to suspend or cancel a customer's access to
any or all of the services provided, if CloudSensy believes the account is being inappropriately used /
misused / improper use / illegal uses / phishing uses / copyright content uses.
Unacceptable Resource Usage /
General
Content Policy
Please be aware that CloudSensy reserves the right to refuse service or access to its servers
to anyone, and that the services we provide must be used for lawful purposes only. All information, data,
and material that violates any legal or regulatory requirements is prohibited. Activities and content that
are strictly prohibited are listed below for your reference. All Comes Under Shared Web Hosting ("Monthly
Web Hosting" "Premium Web Hosting" "Unlimited Web Hosting" "Business Web Hosting" "Reseller Web Hosting").
- It is strictly
prohibited to use phishing or copyright content (based or found) on your website (there will be no
refunds). Also customer cannot use the name of a famous brand or company when buying web hosting or
domain (no refund). This may result in copyright violations or phishing threats.
- Freenom Domains
are not allowed at all. If any account is found, your account will be immediately suspended and a refund
will not be provided.
- It is not
allowed to host copyrighted commercial Images, Mp3, Music, Video & Movies File Websites on our server.
However, only self-created content / copyrighted free content such as graphic, music, video,
songs, file etc, can only be hosted on our VPS & Dedicated Servers (Not allowed in Shared & Reseller
Hosting), which are designed primarily for download.
- Websites with
human trafficking / prostitution / escort services / child pornography / pornography / exploitative
content will be suspended immediately without any prior notice or warning.
- Abuse of
Resource (Resource Limit Is Reached) - Abuse of the CPU or overuse of RAM & CPU are not permitted.
Accounts that abuse the CPU or RAM will be temporarily suspended immediately. In this situation, you
will have to upgrade your account to any upper plans / VPS / Dedicated server or optimize your website
content (plugins, themes, website code, script code) in order to continue using your website. (Refund
will not be granted, however user can use this plan for another website.)
- Our rules
prohibit spamming, bulk email, and marketing e-mail, so we immediately suspend those accounts without
warning. E-mail storage is also forbidden. The maximum number of emails per day / per account is 60.
There is also a maximum size limit per mailbox size upto 500MB depending upon plans. We recommend you to
buy Gsuit or Office 365 for heavy email use, not shared hosting. Shared hosting is designed for running
basic websites, not for high volume email (100 to 500 emails per day).
- CloudSensy
reserve the right to suspend or remove the database that leads to downtime on any of our servers just
because of large size database. Large databases that require constant connections should be hosted on a
VPS or dedicated server. A database that exceeds 250 MB in size would be considered overuse and was not
designed for shared hosting.
In the event that any other content or literature is deemed to be indecent, rude, hateful or
generally inappropriate, CloudSensy reserves the right to make the content or literature "prohibited". We
have adopted procedures to address complaints from third parties that believe a hosted site is violating
their copyright under the DMCA. All complaints should be directed to [email protected]
Abuse Of Resources / zero tolerance policy /
Strictly
Prohibited
In addition to refusing service to anyone, we may restrict access to our servers. All
services provided by us should be used only for lawful purposes. We are prohibited from transmitting,
storing, or presenting any information or material in violation of any applicable laws. This list is
intended to provide examples of activities that are strictly prohibited on our server.
- If you wish to
use your database servers from another web server or desktop application, please contact our sales team
for customized plans. We do not offer database hosting for desktop applications or remote database
connectivity. We will stop any website scripts that are resource-intensive and notify the customer by
email. After the customer fixes the scripts, the scripts can be allowed to run on servers once our
technical team approves it.
- It is strictly
prohibited or immediate termination of service for attempt to compromise a network device, port scan, IP
range scanner, or vulnerability scan that belongs to us, an individual.
- We strictly
prohibit Denial of Service (DOS) attacks directed at CloudSensy or attempts to launch a DOS attack from
our servers. If we found these practices, your account may be immediately terminated.
- Specifically,
hosting any software or source code that could be used for an illegal act is strictly prohibited.
Besides hosting software exploits, exploit sources, hacking tutorials, hacking tools, viruses and
Trojans, bomb making tutorials, and other illegal material is strictly prohibited.
- Our right is to
remove any clients / users from our services without refund if they are disrespectful to any member of
the CloudSensy staff.
- Crack & nulled
themes or plugins, phreaking, hacking, password cracking, pirated contents not allowed. It is also not
allowed to host websites that contain defamatory content about people, religions, communities, or
organizations. IRC Hosts , Bank scams, phony links to banks, similar bank websites, cryptocurrency
realted, forex, e-gold, bots, spam bots, IP scanners, mail harvesting scripts, brute force scripts, mail
bombers, port scanners, drugs, explosives, bulk SMS gateways, malware, warez, phishing materials,
lottery, disk use, pirated software, anonymous ROMs, emulators, phishing, hacking, password cracking, IP
spoofing and encrypting, Illegal gambling, illegal downloads, downloading pirated software, fake
investment programs, and live broadcasts of copyrighted events are prohibited.
- Games (On
Shared Hosting) : If we discover that you are hosting any gaming related stuff on our shared hosting,
your hosting account will be immediately terminated. For game rated website, We have separate Dedicated
Server for this.
Commercial / Marketing E-Mail /
Bulk / SPAM
E-Mail Policy
In addition to refusing service to anyone, we may restrict access to our servers. All
services provided by us should be used only for lawful purposes. We are prohibited from transmitting,
storing, or presenting any information or material in violation of any applicable laws. This list is
intended to provide examples of activities that are strictly prohibited on our server.
- It is expressly
prohibited to send Bulk Commercial E-Mail / Marketing E-Mail / Bulk Spamming E-Mail through our service.
If we found these practices, your account may be immediately suspended / terminated.
- Our policy for
using our service is to not tolerate any messages or commercial advertisements that violate the rules,
regulations, or charter of any newsgroup or mailing list. Only commercial messages that are appropriate
under the rules of the newsgroup or mailing list will be allowed.
- We have set
limits on the number of outgoing mails per hour on our Shared Hosting, Reseller, VPS and Dedicated
Server in order to maintain performance. Therefore, shared and reseller customers can send 60 outgoing
emails per day per account, VPS customers can send 1500 outgoing emails per day, and dedicated servers
can send 1 email every 1 minute. With any of our hosting plans, we cannot guarantee Inbox email
delivery.
Unlimited Disk Space / Unlimited Web Hosting Policy
Unlimited Hosting
Uses Policy
In normal operation of the website, we does not impose or set any limits on the amount of
disk space you are allowed to use. CloudSensy does not set certain disk space limits (INODE Limit will be
there) for hosting subscribers, nor does CloudSensy charge additional fees for exceeding disk size limits,
as long as the hosting subscriber's use of storage according to ur term & conditions.
It is important to note, that our unlimited hosting service is designed for running websites, not intended
to be used as an online storage solution nor to keep backups files online. The unlimited web hsoting service
does not include unlimited space for online storage, keeping videos, large images, audio files, games files,
installers, backups, zip/rar files / any compressed files, documents, log files, irc, torrents files, file
sharing, Email Storage, Database storage etc and any such prohibited use of the services will result in
termination & suspension of subscription. In order to maintain the proper performance of our server,
Subscribers with excessive database sizes (i.e. 250 MB) may be asked to reduce their database sizes or the
account may be disabled, with or without notice. The services we offer "Unlimited Web hosting package" that
means that multiple hosting subscribers' websites share the same server and its resources, making it ideal
for small and medium-sized businesses around the world. It is NOT designed to support the sustained demand
of large enterprises, or non-typical applications that would be better suited to a VPS or Dedicated Server.
The hosting space cannot be used to store backups.

Affiliate
Terms and Conditions
Please read this agreement carefully before registering and using our affiliate service as an
affiliate. By signing up as an affiliate, you agree to abide by the terms and conditions in it. Here you
will find the terms and conditions associated with our affiliate program aimed at helping you earn income by
referring new hosting clients to us.
Products Eligible For Affiliate Commission: ("Monthly Web Hosting" "Premium Web Hosting"
"Unlimited Web Hosting" "Small Business Hosting" "Reseller Web Hosting").
Products Not Eligible For Affiliate Commission: ("Domain Name" "VPS Hosting"
"Dedicated Server" "SSL Certificate" "Business E-Mail").
- Referral
commissions are only eligible for affiliates who refer new clients. Commissions will not be paid for
orders placed by existing clients through affiliates. You will receive a 20% commission on the total
value of your active order, excluding taxes, pending orders, cancelled orders, terminated accounts, and
subscription-completed accounts.
- Paytm, UPI, or
a bank account will receive your payment every time your balance reaches Rs 5000. Affiliates have 365
days or one year to reach Rs 5000. If the Affiliate does not reach Rs 5000 within 365 days or one year,
their affiliate balance will be zero. Affiliates' payout will come in multiples of Rs 5000. For example,
if the user reached Rs 7000, then Rs 5000 will be paid and the rest will be paid once their balance
reaches Rs 5000 again.
- Affiliates are
not eligible for commissions if clients renew their hosting services or purchase other hosting services.
When the client cancels the order, the affiliate's commission is not paid, since it is deemed cancelled.
Affiliates are only paid if the order is in active state.
- We will exclude
GST and payment gateway fees from your compensation amount before paying you. Our affiliate system will
calculate your commission based on the total amount that includes product/service cost, GST, and payment
gateway fees.
- Our affiliate
software system automatically track and calculate everyting, your earning, user click, commissions,
signups etc. Our affiliate software system have Anti Fraud system like duplicate click, self buying, IP
tracking, Geo tracking, cookies tracking etc. If your affiliate earning is not showing it means, that
transactions is not eligible for commissions & CloudSensy is not going to provide you any help for that
transactions. Our affiliate software system are automatic, so whatever status are showing inside your
Dashboard that will be totally correct & we are not going to help you any thing regarding this.
- Before sending
traffic to affiliate link, affiliates need to ensure that their affiliate link is working properly. If
additional changes need to be made to affiliate links, the affiliate is responsible for doing so. Links
edited, masked, redirected, or otherwise manipulated will not receive referral fees. The affiliate
account will be deactivated if false or misleading advertising is found or if suspected fraud is
suspected.
- In the event
that you fail to comply with the Affiliate Terms, your account may be deactivated at any time without
warning or notice. Your account WILL BE DEACTIVATED and referral fees will be set to zero. All affiliate
accounts that generate a large number of fraudulent accounts will be deactivated. If you would like to
discontinue your affiliate status, simply remove all affiliate links from your websites and don't
promote them anymore. Please note that we will not remove your account and any of your personal
information from our system for accounting purposes.
Reseller Hosting /
Reseller
Policy
- It is the
reseller's responsibility to make sure that each of its clients follows this / our term and conditions
agreement.
- Our
responsibility is not to provide support to reseller users, as they are solely responsible for providing
customer service, billing, and technical support for their customers.
- All content
storage or transfer under a reseller account by a reseller and any action taken by a reseller's user is
solely responsible for the reseller.
User Account Policy /
Account
Misuse Policy
- Taking steps to
prevent unauthorized access to your account is your responsibility as you are responsible for any misuse
of your account. It is your responsibility to keep your password secure because it provides access to
your account.
- Taking care and
preventing others from using your account is recommended. You will be responsible for any consequences
resulting from an unauthorized user accessing your password or account. Preventing or minimizing
unauthorized access to your account requires appropriate security measures.
- In addition,
you are responsible for ensuring that all the programs/scripts installed under your hosting account are
secure and directory permissions are set appropriately. Upon discovery of a compromised account, your
account may be suspended or terminated. If your account is not cleaned up after you receive notice of an
ongoing issue, your account may remain suspended.
- Our company
reserves the right to relocate your account to another data center due to Datacenter policies, local
law, technical reasons or other reasons without any prior notification.

Termination / Account Cancellation Policy
- Cancellation
After Expires : We will suspend your hosting account after the subscription expires if you request a
cancellation after your subscription expires and will terminate it within 12- 24 hours after your
subscription expires.
- User Apply for
Cancellation : In the event that you no longer wish to continue using our services and wish to request
for a cancellation by call / chat / portal. Within 12 to 24 hours, your hosting account will be
terminated & all data will be deleted.
- Fail to Renew
on Time : When you fail to renew your hosting account on time, your account will be suspended after 1
hours and terminated within 10 days.
- We do not
tolerate violations of our terms & conditions(TOS) : During CloudSensy's subscription period, any breach
of our terms & conditions(TOS) will result in immediate termination and suspension of your account.
Shared Hosting / VPS / Dedicated Servers
Data Backup
Policy
Shared Hosting ( "Monthly Web Hosting" "Premium Web Hosting" "Unlimited Web Hosting"
"Business Web Hosting" "Reseller Web Hosting" ) Data Backup Policy: Our users are advised to keep a
back-up copy of their hosting account (local computer / local backup drive) every month or day in order
to ensure that their website data is not lost.
The use of the Our Hosting Services is at your sole risk. You agree to make a copy of all
your User Content/Complete website data by customer/user it's own self, so that it may be retrieved and used
if necessary. It is your responsibility to back-up any, all of your User Content, Complete
website/application data & account data, and CloudSensy makes no guarantees regarding this. It is your
agreement as a CloudSensy's User that CloudSensy will not be liable/responsible for any data loss under any
circumstances whether user/customer using "FREE backup service" or "Paid backup services" or both.
A FREE backup service is set up to take a server backup every 30 days (once a month, or 1
copy a month). Backups are generated on random days and replaced with each new backup run, so only one is
saved in backup drive at a time. If you use the "Free Monthly Backup", There is a chance that free monthly
backups may be unavailable due to technical errors and huge customer accounts. In those cases, we may deny
providing FREE backups. However, your use of the service is at your sole risk.
Clients with shared and reseller hosting plans who subscribe to paid backup services. The
websites of such clients are backed up every 15 days by us. There is a 1% to 2% chance of an error while
scheduling or making backups due to technical problems. If you have paid for backup services, we have the
right to deny providing backup of your website/ applications /hosting services account.
Shared Hosting (Account Termination Policy): Users who fail to pay invoices or renew
on time may suffer account termination & all files and data will be erased from server. We will not be
responsible for any loss of data or files by a user who's account in terminated state.
VPS / Dedicated Servers Backup Policy: Since VPS & Dedicated Servers operate as
separate servers, so no FREE backup service comes along with it. However user can buy paid backup services
options while buying. Also Our "SEMI-MANAGED VPS PLANS" comes without "FREE backup service" so use at your
sole risk. Under any circumstance, CloudSensy can not be held responsible for the loss of data.
Invoice Policy / Late Payment Policy /
Non- Payment
Policy
- Invoices that
are not paid by their due date may result in the suspension of that hosting account. Following
suspension, the hosting account will be terminated (delete all hosting related account data) within 10
days.
- CloudSensy will
not be responsible for a user's website data if they fail to renew their hosting account on time or if
their hosting account is terminated (so please renew your account on time). Data residing on a
terminated user account will not be restored and a new account will be created instead if user try to
renew.
- Customers with
outstanding balances on their accounts will not be allowed to place new orders or activate new packages.
After its DUE DATE, if you do not pay our service renewal invoice within five days, then you will be
charged a late fee up to 10% for Renewal.
Domain Buying Policy / Domain Registration Policy / Domain

Payment Policy
- Registered or
Activated domain do not qualify for a Refund.
- Neither do we
sell or provide premium domain names. Also, we do not sell or provide domains with special characters
(example: "σ" "ἀ" "ß" etc.) .
- If a user
attempts to buy or register a domain name that is similar to a trademarked domain or similar to a brand
or engaged in a business providing similar products and services, then that user's domain name will be
considered infringing on the trademark. We will suspend that domain & you will not receive a refund.
- A month or a
day before the expiration date, we will send you an invoice reminder for renewal of your domain name. If
the renewal fails or is delayed, we will not be responsible. Once the domain has been renewed, no refund
will be given.
- It is not
possible for the user to cancel the Domain Transfer process once it is started by using an EPP code. If
the user still wants to cancel the Domain Transfer process, they can stop it by contacting their older
domain provider, but refunds won't be provided back.
Server Availability /
Server
Uptime Policy
In the event that CloudSensy or our network providers experience downtime due to scheduled
maintenance, those interruptions won't be counted towards the server uptime. CloudSensy will not be held
responsible for failures caused by third parties. We will not be liable for delays in performing our
obligations if such delays or failures are caused by circumstances beyond our reasonable control, including
but not limited to war, insurrection, and acts of government. It also includes fires, floods, strikes, or
other labour disturbances, interruptions or delays in transportation, inaccessibility of telecommunications
services (including DNS propagation) and malfunctions of third-party software or hardware. Sometime, It is
necessary to upgrade the server, software, and other tools from time to time. In this case we may need to
shut down some services for some period of time. The customer may or may not be notified 24 hours in advance
about the downtime. Usually, downtime is between 12 and 72 hours. Regardless of the circumstances or
situation, CloudSensy shall not be held liable for any website / application / server downtime. We provide
no uptime guarantees such as 99% or 98%, it's just for reference purposes & no compensations will be
provided for server downtime. Our server is composed of so many third party software and hardware machines,
that it can cause problems at any time, so use our services at your own risk.
Vendor's Price Change / Control Panel Software /
Third Party
Software Policy
No assistance is provided with G Suite, Outlook, Zoho Mail or other third-party software. We
will not be responsible for any errors in any code or script provided by third parties. We are not
responsible for scripts or code that work on other servers or hosting companies but not on our servers.
During this situation, the customer had to contact their code provider or developer to install or run the
code (No refund) . Our pricing may increase or decrease at any time or renewable time if any third party
software license price increases or decreases like Softaculous, Cloudlinux, Litespeed, cPanel, Plesk, etc.
At any time, we reserve the right to change the Web Hosting Control Panel & their Software.
Changes In TOS /
Refusal of
Service
We reserve the right to refuse, cancel, or suspend service at our sole discretion. Customers
are bound by the latest terms published on the website at all times. CloudSensy reserves the right to modify
/ change the terms of service / terms and conditions at any time. This agreement shall be governed by the
laws of the Republic of India. In case of dispute, Haryana (Delhi NCR) would be the sole jurisdiction and
Terms & Conditions can be changed without notice.
DMCA-compliant, Hosting has adopted procedures for parties who claim their copyrights have
been violated by sites hosted on our service. Please contact email-protected
if you believe your copyright has been violated.
